Gaussly Terms of Service

Welcome to Gaussly! These Terms of Service ("Terms") govern your use of the Gaussly mobile application ("App") provided by CanMage, LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

Gaussly is a mathematics education application that:

• Provides animated learning content and interactive questions for math topics covering Grades 1-5
• Allows students to practice math skills through exercises and quizzes
• Tracks learning progress locally on the user's device
• Stores all student data locally without transmitting to external servers
• Functions entirely offline after initial installation
• Does not contain advertisements, external links, or social features

Future updates may expand content to include Grades 6-8.

2. User Accounts and Age Requirements

2.1 No Account Required

Gaussly does not require users to create an account. The App operates without user authentication, and all data is stored locally on your device.

2.2 Age and Parental Consent

• Gaussly is designed for children ages 6 and older
• Children under 13 should use the App under parental supervision
• By allowing your child to use Gaussly, parents/guardians agree to these Terms on the child's behalf
• Parents/guardians are responsible for monitoring their child's use of the App

3. Current Free Access and Future Pricing

3.1 Current Free Access

Gaussly is currently available free of charge with full access to all features and content for Grades 1-5.

3.2 Future Pricing Plans

We reserve the right to introduce paid features, subscriptions, or in-app purchases in the future. If we implement paid features:

• Existing users will be notified in advance through the App
• These Terms will be updated to reflect pricing and subscription details
• Payment processing will be handled by Apple App Store or Google Play Store
• Parental consent mechanisms will be implemented as required by law for children's purchases
• You will have the option to continue using available free features or upgrade to paid plans

4. Educational Content and Learning Progress

4.1 Content Accuracy

While we strive to provide accurate and high-quality educational content aligned with grade-level math standards, we do not guarantee that:

• Content is error-free or complete
• Content aligns with every school district's specific curriculum
• Use of the App will result in specific academic outcomes

4.2 Progress Tracking

• All progress data is stored locally on the device
• Progress is not synchronized across multiple devices
• Uninstalling the App will permanently delete all progress data
• We are not responsible for lost progress due to device issues, uninstallation, or data corruption

5. Privacy and Data Protection

5.1 No Data Collection

As detailed in our Privacy Policy, Gaussly does not collect, store, or transmit any personal information or student learning data to external servers.

5.2 Local Storage Only

All user data remains on your device. You are responsible for:

• Maintaining the security of your device
• Managing device backups (iCloud, Google Drive)
• Ensuring adequate storage space for the App

5.3 Compliance with Privacy Laws

Gaussly complies with children's privacy laws including COPPA and GDPR. Please review our Privacy Policy for complete details on how we handle data.

6. Safe and Appropriate Use

6.1 Educational Purpose

Gaussly is designed exclusively for educational purposes to help children learn mathematics. Users agree to:

• Use the App only for learning and practicing math skills
• Not attempt to misuse, hack, or exploit the App
• Not use the App in any way that violates laws or regulations

6.2 Parental Supervision

Parents and guardians are encouraged to:

• Review the App's content before allowing children to use it
• Monitor their child's progress and usage
• Set appropriate time limits for screen time
• Use device parental controls as desired

7. Prohibited Activities

Users agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or distribute the App's content or code
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for any commercial purpose without our written permission
• Attempt to access or interfere with the App's security features
• Use automated tools or bots to interact with the App

8. Intellectual Property

8.1 Ownership

The App, including all content, animations, graphics, text, software, and educational materials, is owned by CanMage, LLC and protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

You are granted a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, non-commercial, educational purposes

This license does not include any rights to:

• Resell, distribute, or sublicense the App
• Use the App's content in other applications or products
• Create derivative works based on the App

9. Device Requirements and Compatibility

Gaussly requires:

• A compatible iOS or Android device with sufficient processing power
• Adequate storage space for the App and its content
• Internet connection for initial download and updates (optional for ongoing use)

We do not guarantee the App will function on all devices or operating system versions. We are not responsible for device-specific compatibility issues.

10. Updates and Modifications

10.1 App Updates

We may release updates to:

• Add new content and features (including additional grade levels)
• Fix bugs and improve performance
• Enhance security
• Modify existing features or content

Updates may require re-downloading the App or additional storage space.

10.2 Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App. Continued use after changes constitutes acceptance of updated Terms.

10.3 Service Modifications

We may modify, suspend, or discontinue any aspect of the App at any time, with or without notice, including:

• Adding or removing features
• Changing content or curriculum alignment
• Introducing paid features or subscriptions

11. Disclaimers and Educational Limitations

11.1 Educational Supplement

Gaussly is designed as a supplementary educational tool and should not replace:

• Classroom instruction by qualified teachers
• School curriculum and assignments
• Professional tutoring or educational intervention when needed

11.2 No Guaranteed Outcomes

We do not guarantee that use of Gaussly will:

• Improve academic performance or test scores
• Meet specific educational standards or requirements
• Replace the need for traditional math instruction

11.3 "AS IS" Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF CONTENT, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANMAGE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, WHETHER INCURRED DIRECTLY OR INDIRECTLY, RESULTING FROM:

• Your or your child's use or inability to use the App
• Any errors, inaccuracies, or omissions in educational content
• Loss of progress data or learning history
• Device storage issues or technical problems
• Any unauthorized access to your device
• Reliance on the App for academic performance

Some jurisdictions do not allow limitations on implied warranties or limitations of liability for incidental or consequential damages, so the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless CanMage, LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your or your child's use or misuse of the App
• Violation of these Terms
• Violation of any rights of another person or entity
• Any content or data you provide through the App (if applicable)

14. School and Institutional Use

14.1 Classroom Use

Teachers and schools may use Gaussly in educational settings, subject to these Terms. For institutional licensing or volume deployments, please contact us at support@canmage.com.

14.2 Compliance with Educational Policies

Schools and teachers are responsible for ensuring Gaussly's use complies with:

• District technology policies
• Student privacy requirements (FERPA, COPPA)
• Acceptable use policies
• Accessibility requirements

15. Termination

15.1 Termination by User

You may stop using the App at any time by uninstalling it from your device. This will permanently delete all local progress data.

15.2 Termination by Us

We reserve the right to terminate or restrict access to the App at any time, without notice, for:

• Violation of these Terms
• Misuse or abuse of the App
• Any other reason at our sole discretion

15.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must delete all copies of the App from your devices
• All local data will be permanently deleted
• Provisions regarding intellectual property, disclaimers, and limitations of liability survive termination

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

16.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in King County, Washington.

16.3 Informal Resolution

Before filing any legal claim, you agree to contact us at support@canmage.com to attempt to resolve the dispute informally.

17. Additional Legal Terms

17.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CanMage, LLC regarding the use of the App and supersede any prior agreements.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

18. Third-Party Services

Gaussly may use third-party services for:

• App distribution (Apple App Store, Google Play Store)
• Analytics (anonymized, as described in our Privacy Policy)
• Payment processing (if subscriptions are introduced)

Your use of these services is subject to their respective terms and conditions.

19. Accessibility

We strive to make Gaussly accessible to all learners. If you encounter accessibility issues or have suggestions for improvement, please contact us at support@canmage.com.

20. Feedback and Suggestions

We welcome feedback about Gaussly. If you provide suggestions, ideas, or feedback ("Feedback"), you grant us the right to use, modify, and incorporate such Feedback into the App without compensation or attribution.

By using Gaussly, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you are a parent or guardian, you agree to these Terms on behalf of your child.
